L’Oreal were stopped by the EU trademark office when registering the right of the word “botolist” and “botocyl” and recently the European Courts have backed the ruling to prevent L’Oreal registering the these words.

The EU Court of Justice backed earlier refusals by the EU trademark office for L’Oreal to own the rights to the words“botolist” and “botocyl” for cosmetic products.

Allergan Inc have always defended their brand name botulinum toxin type a, Botox which is the most established and very widely used cosmetic and medical product. Recently new products have entered the market and Allergan are trying to protect the Botox brand name.

The court statement

“The use of the marks at issue would take unfair advantage of the reputation of the ‘Botox’ trademarks,” according to a court statement today.

A spoke person for Allergan said.

“This court ruling reinforces Allergan’s position that the Botox name should only be used in relation to the Allergan product”

L’Oreal have introduced their own botulinum toxin called Azzalure which is in direct competition with Allergan’s Botox.

Many of us will remember Hoover the vacuum cleaner manufacturer and how brand awareness was affected by trademark name usage and their brand becoming a generic word for any vacuum cleaner.

We are frequently asked before candidates attend the botox training courses.

How much do I charge my patients for the BOTOX® cosmetic treatments?

BOTOX® Treatments and Prices in the US

In the USA patients are charged for each unit of BOTOX® used for the treatment thus 25 units of BOTOX® used will cost the patient (direct cost times 10 times markup). In short if the cost of material used is $25 dollars, the retail price is approximately $250.00.

What about the price of BOTOX® in the UK?

In the UK the price structure is different most cosmetic practices will price their botox treatments by area, with a slightly increased price for male patients who may require more BOTOX® units for the treatment.

A patient who requires 1 area treated would be a set price for example a treatment for the frown lines between the eyes, the glabellar area would use approximately 25-30 units of BOTOX® and prices may vary from £125-£200 plus depending on the patients sex, clinic location and clinician. Occasionally you will see special offers from some providers at a reduced price for certain areas.

Registered Nurses and Botulinum toxins for Cosmetic Use

Recommendation for Nurses Attending Dermal Fillers Courses and Botox® Training.
Nurses registered with the NMC and RCN in the UK can attend * KT Training Botox® and Dermal Filler Courses.

Note *Botox® and Registered Nurses Botulinum toxins are prescription only medicines and nurses must review their guidelines regarding the prescribing and administration of prescription only medicines. Please see guidance regarding the remote prescription of Botulinum Toxins for cosmetic use and nurses.

We recommend that nurses who wish to provide Botox® cosmetic treatments follow the guidance provided by NMC.

It is recommended that nurses acheive the independent nurse prescribing qualification which will allow the Nurse to provide a patient specific private prescription.

Registered nurses should also review MRHA Botulinum Toxin prescribing and administration information web page and the Department of Health guidelines regarding these procedures.
